After a nearly three-week trial, partner Adam E. Deutsch won a jury verdict of $790,000 in Supreme Court Suffolk County. Our client had a hip arthroplasty performed by Dr. Eugene S. Krauss a prominent hip surgeon on long island and the Director of the Department of Orthopedic Surgery at Syosset Hospital. Within two weeks of the procedure, the hip dislocated twice, requiring Dr. Krauss to perform a revision hip surgery. The multiple traumas to our client’s hip in such a short period caused permanent pain and loss of range of motion. Our claim was that the acetabular component of the hip replacement was put in with incorrect anteversion, a key measure of the adequate alignment of the hip prosthesis. Dr. Krauss denied these allegations and refused to negotiate during the course of litigation thereby necessitating a jury trial. Dr. Krauss called Michael Bronson, M.D. as an expert witness in support of his case. Dr. Bronson is the chief of hip replacements at Mount Sinai Hospital in New York. Despite the aggressive defense, we were able to prove that the implant was in fact put in negligently. After nearly 4 hours of deliberation the jury returned a verdict in our client’s favor.
