Fiedler Deutsch, LLP settled a medical malpractice case during trial today in Dutchess County Supreme Court for $750,000.
The case involved a woman who presented to the emergency room with three weeks of abdominal pain. A pregnancy test revealed she was pregnant which was a surprise as she didn’t believe she could become pregnant. Unfortunately, the OBGYN diagnosed her with an ectopic pregnancy and recommended the pregnancy be terminated with a medication called methotrexate. The clients agreed to the medication at the doctors recommendation. She was sent home. Three days later she returned to the emergency room with continued pain. The OBGYN brought her to the operating room for an exploratory laparotomy and dilation and curettage. The procedure revealed a terminated viable intrauterine pregnancy that had been misdiagnosed as an ectopic pregnancy.
