After nearly four years of hard-fought litigation with two defendants, a doctor and an upstate hospital, we reached a settlement after 6 days of trial. Prior to the trial defendants refused to take responsibility for our 78-year-old clients anoxic brain injury. Our client presented to an upstate hospital with complaints of generalized weakness and was seen by the defendant physician who ordered a CT scan. While in the CT scan our client suffered a cardiac arrest leaving him with an anoxic brain injury. Our contention among others, which the defendants denied, was that the CT was unnecessary and that if necessary, the patient had to be properly monitored while in the scanner which did not happen. Claims also involved the failure to properly diagnose his condition and failing to properly monitor and treat his low oxygen saturation throughout the day at the hospital. Defendants refused to discuss settlement until 6 witnesses were produced at trial. Win. It’s what we do.
